Advantages of Mediation

Mediation refers to a form of alternative dispute resolution (ADR) in which the parties to a lawsuit meet with a neutral third-party in an effort to settle the case. The purpose of mediation is to avoid the time and expense of further litigation by settling a lawsuit early on in the process. Mediation has multiple advantages over traditional litigation in all areas of the law:

Due to the overcrowding in the court system you may not get your day in court for months or even years. Unlike litigation, which pits the parties against each other in an antagonistic environment, mediation focuses on finding common ground and common goals. Mediation fosters an environment of respect making it easier to hear both sides of the story. You are in control of the outcome instead of leaving your fate to a Judge or jury.

In cases where emotions run high, like divorce, child custody, elder care or negligence, mediation gives you a confidential, private and relaxed atmosphere to express those emotions without fear of bias, embarrassment or shame. In volatile cases, where there is abuse or a history of discord we offer separate rooms and a safe environment for each party, while enabling constructive communication between the two parties.

Economically, mediation is much more cost effective than a long trial and usually results in greater satisfaction with the outcome. Mediation gets to the heart of the matter quickly, determining what can be agreed upon immediately and then delving into the tougher issues. The parties and their attorneys focus on the facts without the need for grand-standing or showmanship which in turn saves time and money.

Mediation also offers greater emotional stability to the parties. Particularly when children are involved, the manner in which the parents conduct themselves throughout a divorce or separation is critical to the child’s mental health. The stress of a divorce and/or trial can bring out the absolute worst in someone, rendering the parent angry and depressed. When a parent shows animosity or sadness towards the other parent in front of the children, they are directly affected. Mediation allows the couple to each give input into the final decision, taking responsibility for the outcome and resulting in greater civility to the other party. Preserving a working relationship for the sake of the children is key.
